The Constitution in Exile : How the Congress and the Courts Stole Your Freedom and Your Property

Star FullStar FullStar FullStar FullStar Half

(Hardcover)-The Constitution permits Congress to regulate interstate commerce which, as Fox News analyst Judge Napolitano proves, has opened the floodgates of federal abuse, as the government trounces on state and individual rights, expanding its reach far beyond what the Framers intended. With no-nonsense clarity, Napolitano shows that Congress has "purchased" regulations by bribing states-giving huge amounts of taxpayer dollars on condition that states enact regulations of human behavior that Congress prefers but cannot legislate. Tapping into the intense distrust of activist judges, Napolitano also explains how the Supreme Court has devised historically inaccurate, logically inconsistent, and even laughable justifications to approve what Congress has done.

As a resident of California, I have witnessed a "State of Emergency" during at least two times due to riots. I know what it means, especially to my civil rights, and the State Constitution. As soon as I bought this book I began to thumb through it looking for those words. They were NOT there. No where in this book does the author mention that each year each President sends a letter to Congress declaring that this country is in a "State of Emergency." I was hoping this brilliant author would explain in legal terms what this means to our U.S. Constitution. He did not. So I read, and I read. It was all very informative. But I felt like I was in a room of people telling the Emperor how wonderful he looked in his new clothes when I could see myself he was standing there stark naked. All of his opinions on todays Constitutional issues are moot if the Constitution has been suspended due to "the threat of terriorism." As I read I kept harking back to the Iran-Contra Hearings and Rep. Brooks (R-TX) asking Ollie North, "Col. North, did you participate in the drafting of the document that suspends the Constitution of the United States in a State of Emergency?" And I remember with horror when Inioua (sp?) of Hawaii stated, "Rep. Brooks, may I remind you, THAT is classified information." I do wish the Judge would write a new book in all the "naked" truth. Good buck but I can't get over how similar all his law books are. All the author does is list case after case then writes in a sentence or two about how outrageous it is that are rights are being taken away. Half way through reading the book it can be a chore to get through the rest of the cases.

Judge Napalitano hit a home run with this book! The writing is good and very interesting and if you like the subject matter, you'll love this book! I would recommend this book to anyone who wants to learn what happened to our country's political bible and how we strayed from what our Founding Fathers envioned.
